Terms & Conditions for Classes by Leon & Son
This Event Agreement ("Agreement") is entered into as of the date of purchase of a ticket for the event ("Event") by the attendee ("Attendee") and Leon & Son Wine and Spirits, located at 997 Fulton St, Brooklyn, NY ("Wine Store"). By purchasing a ticket and/or attending the Event, the Attendee agrees to the following terms and conditions:
1. Event Details

The Event will take place at the date and time noted in the event listing on leonandsonwine.com.

The Event will feature a tasting of select wines, as determined by the Wine Store.
2. Eligibility
-
Attendees must be at least 21 years of age to participate. A valid government-issued photo ID must be presented upon entry.

The Wine Store reserves the right to refuse entry to individuals without proper identification.
3. Ticket Purchase and Refund Policy
-
Tickets for the Event are non-refundable and may be transferred to another party up until 24 hours prior to the Event start time.

In the event of cancellation or rescheduling, the Wine Store will notify the Attendee via the contact information provided at the time of purchase.
4. Assumption of Risk

The Attendee acknowledges that participation in the Event involves the consumption of alcoholic beverages and accepts full responsibility for their actions and well-being during and after the Event.

The Wine Store shall not be liable for any injuries, damages, or losses resulting from the Attendee's participation in the Event.
5. Responsible Consumption
-
The Wine Store encourages responsible consumption of alcohol. The Attendee agrees not to consume wine in excess and to refrain from operating any vehicle or engaging in any activity that may endanger themselves or others after the Event.

The Wine Store reserves the right to deny service to any Attendee who appears intoxicated or otherwise unfit to continue participating.
6. Limitation of Liability

To the fullest extent permitted by law, the total liability of the Wine Store, its employees, agents, or affiliates for any claims, damages, or losses arising out of or related to the Event shall be limited to the amount paid by the Attendee for the ticket to the Event.
7. Indemnification
-
The Attendee agrees to indemnify, defend, and hold harmless the Wine Store and its employees, agents, and affiliates from and against any and all claims, liabilities, damages, or expenses arising out of or related to:

The Attendee's participation in the Event;

Actions, omissions, or conduct of the Attendee or their guests; and
-
Claims made by any third party, including invitees of the Attendee, resulting from the Attendee's actions or presence on the premises.
8. Release of Liability for Third-Party Invitees

If the Attendee invites guests or other individuals ("Invitees") onto the property in connection with the Event, the Attendee assumes full responsibility for the conduct of those Invitees. The Attendee agrees to indemnify and hold the Wine Store harmless from any claims, damages, or injuries arising from the Invitees' actions.
9. Insurance Coverage (for Groups or Special Events)

For private group tastings or events involving large parties or special activities, the Wine Store may require the Attendee or Event organizer to provide proof of liability insurance coverage, naming the Wine Store as an additional insured. Such coverage shall include, at minimum, general liability insurance with limits of not less than $1,000,000 per occurrence and $2,000,000 aggregate.

Certificates of insurance must be submitted to the Wine Store no later than [Number of Days] days prior to the Event.
10. Facility and Property Use

The Attendee agrees to respect the Wine Store's property and facilities. Any damage caused by the Attendee or their Invitees to the Wine Store’s property will be the sole responsibility of the Attendee.

The Wine Store reserves the right to assess repair or replacement costs for any damages resulting from misuse or negligence.
11. Photography and Media Release

By attending the Event, the Attendee grants permission for the Wine Store to capture photographs or video footage during the Event, which may be used for marketing or promotional purposes. If the Attendee objects to such use, they must notify the Wine Store in writing prior to the Event.
12. Force Majeure
-
The Wine Store shall not be held responsible for delays or cancellations of the Event due to circumstances beyond its reasonable control, including but not limited to acts of God, government restrictions, pandemics, labor disputes, or unforeseen emergencies.
13. Governing Law
-
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.
14. Severability
-
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
-
This Agreement constitutes the entire understanding between the Wine Store and the Attendee with respect to the Event and supersedes all prior agreements or understandings.
